Statement

Of the participants of the gathering of March the 29th 2015, in front of the Peace Palace, the Hague, The Netherlands

 The tragic story of Farkhunda, a young Afghan woman, attracted media attention Worldwide. A mob of angry men beat 27-year-old Farkhunda before throwing her body off a roof, running over it with a car, setting it on fire and throwing it into a river near a well-known mosque. This happened on the 19th of March 2015 within a distance of 1km from the presidential palace in Kabul city.

The brutal lynch of a woman, by a angry mob, on wrong accusation, and the inaction of 13 policemen present at the seen, are for us the reason of great sorrow and concern. That is why we have gatherd in front of the Peace Palace in the Hague, the judicial capital of the World, to demand justice for the family of Farkhunda, to demonstrate our solidarity with Afghan women, to support the freedom of expression in Afghanistan and to convey our concerns to international community, the government and social society of Afghanistan, and ask them to invest time and resources to strugle against the following root causes of this tragic incident:

-       The mob thought, acting on the order of the mullah will be deamed legal and acceptable. This means the principle of judicial monopoly of the State, inshrined in all constitutions of Afghanistan, has not yet found it’s way in the minds of a big part of the society. The mob involved in this incident were predominantly yong men. They are grown in the past 13 years as the citizen of the pro-Western government of  Afghanistan. The government, obviously, has not been able to include basic knowledge about the state and the principles stipulated in our Constitution to the school sylabus for childeren and yonger generation. This has to be done. Teachers should be asked to talk about constitutional principles related to their subject, even if it is not inculded in the school-book. The ministry of justice should collaborate with the ministry of education in examining the legal awareness of the childeren and school childeren. Not every one in Afghanistan is happy with the democratic principals of our constitution. Therefore, continious attention of the International community is a must, in this regard.

-       The police, is educated for, and get payed to provide security for the citizen of Afghanistan. The police of Kabul city, however, failed to take its responsibilty and defend the live of Farkhunda. A mare warning by the police, could change the situation. Can the people of Afghanistan trust such a police? In the fight against the insurgency, the police of Afghanistan are doing a good job. But in it’s own traditional job, namely, providing protection and security and guarding law and order, serious lawlessness and corruption are observed in the work of local and national police. This is a result of systematic corruption from the highest to the lowest levels of the ministry of interior during the past 14 years. From the other side, the poor legal awarness of the police agents and even police officers,  can be named as one of the reasons behined the failiare of the 13 police and their officers at district and city office, to protect Farkhunda. But the failiare does not end to the city police. The irresponsibility of police goes much higher. The incident has taken at least two hours from accusing tell beating, stoning, burning, again stoning. It is impossible that higher officials in the ministy of interior, including the minister have not been aware of what was going on in the city. We assume, they have been aware but have done nothing to prevent the disaster. Communities can’t feel save, without ensuring the judicial monopoly of the State. State can’t practice it’s judicial monopoli, unless all law and order and judicial institutions be cleared from all forms of corruption and function under strong and expert leadership. 

-       The ministry of Guidance and Religious Affairs (Ershad, haj wa awqaf) is an important institution in the government of Afghanistan. During the Karzai era, however, the main activity of this ministry was arranging the annual piligrimage of the high state officials and their relatives to Meka. But in the same period thousands of private madrasa’s (relgious schools) with mysterious financial resources, propagating perverted believes on Islam, were established arround the country. This controvercial development, supported by neighbouring and regional contries, is still going on. It will creat serious problems for the stabality and security of Afghanistan. The footprints of madrasa’s can be find in the conflict resulted to mob-lynch of Farkhunda.

In order to bring aan end to this problem, the ministries of education and religious affairs should take concret and serious steps to dissolve madrasa’s financed from outside of Afghanistan and through legal measure force other madra’s to use the sylabus of the official madrasa’s. These steps needs only a strong leadership and commitment to the national intrests of Afghanistan. A watching eye from the United Nations will be helpful.

-        Justice in the case of Farkhunda, kan be helpful for abondoning the mentalty of lawlessness by some ordinary people and inactivity by the police. It is therefore very important to give a strong massage to the both groups by establishing justice in this case. We demand the judicial athorities of Afghanistan to deal seriously with the case of Farkhunda and punish the guilty persons properly. International institutions and human rights organisations can play an important moral rol in this regard. Afghan community in Europe is watching what happens in the country and reacts when necessary. We will continue to follow the case of Farkhuna.
