Conference on Transitional Justice in Afghanistan

                                         December the 9th to 11th

                                            RESOLUTION

The Federation of Afghan Refugee Organisation in Europe FAROE held from December 9th to December 11th 2005 a conference under the titled “Transitional justice in Afghanistan” at the institute of Kontakt Der Kontenten in Soesterberg the Netherlands. A great number of Afghans representing various Afghan social and cultural organizations in Europe and America took part in the conference.

In view of their obligation towards some undesirable political developments in our country, which emanates from certain shortcomings of the Bonn Peace Process, participants of the conference reached agreement to concentrate their efforts on the following points:

 

-          Trial of individuals suspected of war crimes and human rights violation as a basis for a fair society, carrying out justice and a society free of personal revenge.

-          Trial of individuals suspected of war crimes and human rights violations as a precondition for replacing the power of gun with the rule of law and implementation of the principal of democracy.

-          Trial of individuals suspected of war crimes and human rights violation as a measure to prevent recurrence of such crimes in the future as a consequence of prolonged war.

-          Holding of periodical conferences by Afghans living abroad and occasionally Afghans living inside Afghanistan about the trail of individuals suspected of war crimes and human rights violation so as to prevent forgetting the issue.

-          Appreciation of efforts made by United Nation, national and international human rights organisations in bringing to justice of individuals suspected of war crimes with a remarks that these activities are not enough.

-          Proposing an international conference with the assistance of United Nation and other human rights organisations on bringing suspects of war crime and human rights violation

This conference is an effort for coordination of activities of national and international human rights organisations for setting up of special international tribunal, until the situation becomes favourable inside our country.

It is mentioning worthy that the issue of war crimes and human rights violation involved during the conflict in the past three decades .must never be used as political tool against certain groups or parties.

Participants of the conference emphasized that the commitments of current government to international community emanating from the agenda of war on terror, has led to the sharing of power with a large number of persons suspected of war crime and human rights violation. This put the government in unsuitable position in bringing these suspects to justice. Therefore, until favourable political changes in the future, for the time being; the national and international human right organisations must try to draw the attention of international community through seminars, conferences, issuing reports and statements about this problem.
